Adrian Bingham

Adrian graduated from Cambridge University in 1984 with an English degree. He trained at a predecessor firm of Lovells and qualified in 1988. Adrian was a Partner at Hextalls before joining Davenport Lyons as a Partner in 2009.

Adrian's practice focuses on construction and insurance, in particular professional indemnity disputes involving architects, engineers, solicitors, surveyors and valuers. He also advises on contentious and non-contentious construction work, including representing developers, contractors and other organisations on delay and disruption claims and disputes over interim and final accounts, and drafting and advising on construction contracts, professional terms of retainer, collateral warranties, and other industry documents.

Adrian handles commercial insurance disputes arising out of coverage issues, material non-disclosure, third party rights, and the management of insurance schemes and delegated authorities.

In addition he advises on property claims including breach of contract, specific performance, disputes over title and rights of way, subsidence/heave, compulsory purchase, and environmental pollution and nuisance.

Recent experience includes:

  • The RSA Pursuit Test Cases (2005) - defence of concerted challenges by defence insurance market to ATE legal expenses insurance scheme, involving allegations of champerty, fundamental flaws in underwriting methodology, and breach of Access to Justice Act 1999.
  • A&S Enterprises v Kema Holdings (2005) - decision of construction adjudicator successfully overturned on grounds of perceived bias and breach of natural justice.

Adrian is an accredited construction adjudicator on the TeCSA panel and a panel mediator for ADR Group, CIArb, Clerksroom and LawWorks. He is a member of the Chartered Institute of Arbitrators (MCIArb), Society of Construction Law and TeCSA.

Adrian is co-author of the Professional Indemnity chapter of “Insurance Disputes”, published by Informa Press and is a regular speaker at construction and insurance seminars.

When not at work, Adrian enjoys cricket, racket sports, chess, fly-fishing and wine.
