Janet Ayres

Janet graduated from Southampton University with an Honours degree in Law. She trained at Stephenson Harwood and spent most of her career working for city firms until joining Davenport Lyons as a Partner in 2002.

Janet‘s practice focuses on commercial property related contentious matters, acting for the full range of property clients - major property and development companies, property investment companies, charities, accountants, insurance companies, quasi-Governmental bodies and lending institutions. 

Recent experience includes:

  • All aspects of commercial landlord and tenant litigation including Landlord and Tenant Act 1954 (as amended) matters as well as breach of covenant and forfeiture claims.
  • Rent Reviews. Janet has recently acted successfully for Maxwell’s Restaurants Limited in connection with a disputed rent review in connection with one of their Central London restaurants. The dispute revolved around the interpretation of the rent review clause and led to a successful claim for rectification of the lease.
  • Dilapidations claims.  At present Janet has a number of claims on foot, acting for both landlord and tenant.
  • Disputes relating to any aspect of tenant’s break options or break clauses. 
  • Contractual disputes involving property – in the context of sale or purchase of property, normally commercial property but also residential property. 
  • Insolvency insofar as it relates to property – including liquidation, administration, LPA receiverships, bankruptcy and how these affect owners of property, landlords, tenants and third parties. Janet also does work for Insolvency Practitioners in relation to insolvency matters and has some experience of Criminal Justice Act receiverships
  • Enforcement of legal and equitable charges over property on behalf of the mortgagees
  • Enfranchisement claims – acting for both landlords and tenants.
  • Disputes between neighbours including right to light claims involving both mainly commercial but also residential property.
  • Janet acts as solicitor to Covent Garden Market Authority in connection with their property litigation and some other matters relating to New Covent Garden Market.  CGMA, located in Vauxhall, South London have some 250 tenants within the Market and, as a result, Janet deals with a wide range of problems involving the numerous tenants.  CGMA also have the powers of a local authority to prosecute anyone breaking their Byelaws!
  • Professional Negligence Claims – usually against surveyors or solicitors in connection with a property related matter
  • Trust and estoppel issues in so far as they relate to property and the ownership thereof.  Janet has just recovered a property, now sold for £1.8 million, for a client who had put up the purchase price some 15 years ago but who had failed to ensure the property was registered in their name.  It took an adjudication before the Adjudicator to the Land Registry and then an application to the Court but Janet’s client obtained control of the property and it has now been sold. 

Janet is a member of the Property Litigation Association and has spoken at seminars both internally at DL and externally.

Out of the office Janet likes walking, golf, swimming (preferably somewhere warm), skiing, the theatre, playing bridge and reading.
