| Samantha
joined Davenport Lyons’ Corporate & Personal
Recovery Group in January
2004. She qualified as a solicitor in September
2001 and became an associate in July 2007.
Samantha specialises in contentious insolvency, both
corporate and personal. She acts for insolvency practitioners
and for companies and individuals on insolvency related
issues.
She also undertakes general commercial litigation
and has assisted on a number of large-scale fraud
actions for corporate clients involving urgent Freezing
Orders and Disclosure Orders and the tracing of assets.
Samantha also assists Trevor Sears, UK counsel to
IATA, with his travel insolvency cases.
Notable cases which Samantha has assisted in are as
follows:
- Acting for the Liquidators of Southern Cross
Group plc, a high profile Liquidation reported extensively
in the media, on a wide range of issues which included
Freezing Orders and proceedings against a number
of parties.
- ABTA –v- Nardi relating to a fraud perpetrated
by an employee included Freezing and Disclosure
Orders and the tracing of assets.
- Acting for various Trustees in a number of high
profile bankruptcies including Bruce Grobbelaar,
the former Liverpool goalkeeper, and Magenta Devine,
the former co-presenter of The Rough Guide. To include
the tracing of and realisation of assets both in
the UK and abroad.
- Acting for FPLAC LLC (a Delaware Limited Liability
Company) in respect of certain debts and securities
assigned from Comerica Bank to FPLAC LLC including
securities over certain film rights and advising
in respect of protecting and realising those securities.
This case covers assets and securities both in the
UK and USA.
- Lesser –v- Lawrence acting for the Trustee
in Bankruptcy. This mattered concerned whether a
bankrupt’s rights to a retirement annuity
and associated benefits under an annuity contract
or personal pension plan vested in their Trustee,
and whether payments derived from those rights were
required to be the subject of an income payments
order.
- Acting for AOL (UK) Limited on a number of debt
recovery related matters.
