| Julie
Killip qualified as a solicitor in 1984. Prior to
joining the Corporate & Personal Recovery Group
of Davenport Lyons in January 2002, in which she is
a partner, she was a partner at Mishcon de Reya.
Julie specialises in contentious insolvency, both
corporate and personal, and acts not only for insolvency
practitioners, advising and assisting them in their
administration of insolvent estates, but also for
companies, partnerships and individuals on insolvency
issues (their own and client related).
She also has a wide range of commercial litigation
experience. In particular she has conducted many large-scale
fraud actions for corporate clients involving urgent
pre-action injunctions (search and seize orders, freezing
orders, disclosure orders) and the tracing of assets
on an international scale.
She also has wide experience of partnership and shareholder
disputes and professional negligence work (particularly
accountants).
Reported cases include:
- Denny-v-Yeldon which involved a company pension
scheme appointment and the removal of Trustees,
the issue being whether administrators have the
power to remove an independent trustee after a pension
scheme is fully paid up.
- Lombard North Central Plc v Stobart regarding
promissory estoppel.
- In Re Doltable Limited relating to the court’s
refusal to grant an Administration Order to an SPV
on the basis it did not trade.
- Sabre International Products Limited on the enforcement
of liens against administrators.
- Glen Express Limited in a ruling against double
proof for the same debt.
- Brand Connection Limited & Others-v-Patel
& Others which involved an in-house fraudulent
scheme and conspiracy to defraud.
- ABTA –v- Nardi relating to a fraud perpetrated
by an employee and the tracing of assets.
- The Guildford and Woolwich Bombing Inquiry and
the Judith Ward Appeal when she represented the
forensic scientists who had been employed by the
MOD at the time of the IRA bombing campaign in the
1970s.
Julie has also contributed in the past to the Insolvency
Chapter of Accountancy Manual.
